These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Product Maestro (“Company”, “we”, “us”, or “our”), concerning your access to and use of:
- Related pages and paths on those domains (including conniekwan.com/4storyteller)
- Any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto
Collectively, these are the “Site.” By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with all of these Terms of Use, you are prohibited from using the Site and must discontinue use immediately.
We may update these Terms of Use from time to time. We will revise the “Last updated” date when we do. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
The information on the Site is not intended for distribution or use where such use would be contrary to law or would subject us to registration requirements. If you access the Site from another location, you are responsible for compliance with local laws.
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (the “Content”), and the trademarks, service marks, and logos contained therein (the “Marks”), are owned or controlled by us or licensed to us, and are protected by intellectual property and unfair competition laws.
The Content and Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our prior written permission.
If you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use. We reserve all rights not expressly granted to you.
3. User Representations
By using the Site, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Terms of Use; (2) you are at least 18 years old (or the age of majority where you live); (3) you will not access the Site through automated or non-human means (bots, scripts, etc.), except for ordinary search-engine indexing; (4) you will not use the Site for any illegal or unauthorized purpose; and (5) your use of the Site will not violate any applicable law or regulation.
If you provide information that is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your access and refuse current or future use of the Site.
4. Purchases and Digital Products
If you purchase a course, coaching, or other product or service through the Site, additional checkout terms, refund policies, and payment-processor terms may apply. Where those conflict with these Terms of Use on purchase-specific matters (for example, refund windows for a specific product), the purchase-specific terms control for that purchase.
5. Prohibited Activities
You may not use the Site for any purpose other than that for which we make it available. Without limitation, you agree not to:
- Systematically scrape or harvest data from the Site without our written permission
- Attempt to gain unauthorized access to accounts, systems, or networks
- Circumvent or interfere with security or access controls
- Upload malware, spam, or other harmful material
- Harass, abuse, or harm others, or impersonate another person
- Copy, reverse engineer, or adapt the Site’s software except as allowed by law
- Use the Site in violation of any applicable law or regulation
- Use the Site to compete with us or commercially exploit Content without permission
6. User Contributions and Feedback
If you submit questions, comments, suggestions, ideas, or other feedback (“Submissions”), you agree they are non-confidential and we may use them for any lawful purpose without compensation to you, to the extent permitted by law. You retain ownership of content you create, except as needed for us to operate the Site and as described in our Privacy Policy.
You are solely responsible for any content you provide and agree not to submit content that is illegal, infringing, misleading, or otherwise prohibited.
7. Site Management and Availability
We may monitor the Site for violations of these Terms, take appropriate action (including terminating access), and manage the Site to protect our rights and keep the Site functioning properly.
We may change, suspend, or discontinue all or part of the Site at any time. We do not guarantee uninterrupted availability and are not liable for downtime, delays, or maintenance-related interruptions.
8. Term and Termination
These Terms of Use remain in effect while you use the Site. We may deny access to the Site, in our reasonable discretion, for breach of these Terms or applicable law. If your access is terminated, you may not create a new account under another name to circumvent that termination.
9. Disclaimer
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be error-free, secure, or uninterrupted, or that Content is complete or accurate.
Educational and coaching content is for informational and professional-development purposes and is not a guarantee of specific career, business, or financial outcomes.
10. Limitations of Liability
To the fullest extent permitted by law, we and our directors, employees, and agents will not be liable for any indirect, consequential, incidental, special, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site.
Our total liability to you for any claim arising out of or relating to the Site or these Terms will not exceed the greater of (a) the amount you paid us for the product or service giving rise to the claim during the twelve (12) months before the claim, or (b) one hundred U.S. dollars (US $100).
Some jurisdictions do not allow certain limitations; if those laws apply to you, some of the above may not apply, and you may have additional rights.
11. Indemnification
You agree to defend, indemnify, and hold us harmless from and against claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of: (1) your use of the Site; (2) your breach of these Terms; (3) your violation of any law or third-party right; or (4) any content you submit.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
Except for claims seeking injunctive or other equitable relief to protect intellectual property rights, any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved informally by contacting us. If not resolved within thirty (30) days, either party may bring the dispute exclusively in the state or federal courts located in San Mateo County, California, and each party consents to personal jurisdiction there.
Nothing in this section limits either party’s right to seek temporary injunctive relief in an appropriate court.
13. Electronic Communications
Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications from us, and agree that electronic agreements, notices, and records satisfy any legal writing requirement.
14. Miscellaneous
These Terms of Use, together with our Privacy Policy and any product-specific terms presented at purchase, constitute the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. We may assign our rights and obligations. No joint venture, partnership, employment, or agency relationship is created by these Terms or your use of the Site.
